Terms of Service

1. Acceptance of Terms

By accessing or using Ferqon Server, the Revyr Labs website, or related services (“Services”), you agree to be bound by these Terms of Service. If you do not agree, do not use our Services. You represent that you are at least 16 years old.

2. License Grant

Revyr Labs grants you a perpetual, non-exclusive, non-transferable license to use Ferqon Server according to the purchased tier. License keys are provided upon purchase and are required for continued use beyond the trial period. The license fee includes a fixed update window during which new releases are available. The software continues to operate after the update window expires, at the last version you obtained.

3. Permitted Use

• Free Use: Individual development and testing on personal projects (Personal tier)
• Users: Personal (1), Team (20), Lab (50)
• Active servers: Personal (1), Team (2), Lab (4)
• Device joins: unlimited device joins on all tiers

4. Prohibited Activities

• Reverse engineering or attempting to extract source code
• Sharing license keys with unauthorized users
• Using Services for illegal or unauthorized purposes
• Circumventing active server activation limits
• Distributing modified versions of Ferqon Server

5. Account Registration

Account registration is optional for license management. Registered users can:

• View and manage active licenses
• Deactivate servers to free activation slots
• Access purchase history and receipts

6. Payment Terms

• One-time Payment: Free ($0.00), Pro ($290.00), Premium ($790.00). 40% off list price on paid tiers during early-access beta (Free tier is always $0).
• Update Window: Free (1 year of updates), Pro (2 years of updates), Premium (3 years of updates)
• Refund Policy: 30-day money-back guarantee from purchase date
• Payment Processing: Processed securely via Stripe

7. Termination

We may terminate access for violations of these terms. You may deactivate licenses at any time through your account portal. Upon termination, you must cease using Ferqon Server. Refunds available within 30 days of purchase.

8. Intellectual Property

All software, documentation, and intellectual property remain owned by Revyr Labs. Your license grants usage rights only, not ownership of any intellectual property.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OPERATION OR COMPATIBILITY WITH ALL HARDWARE PLATFORMS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REVYR LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE LICENSE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $0 IF YOU HAVE NOT PAID FOR A LICENSE.

11. Indemnification

You agree to indemnify, defend, and hold harmless Revyr Labs and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of your violation of these terms, your use of the Services, or your violation of any law or the rights of a third party.

12. Arbitration and Class Action Waiver

ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL BE DETERMINED BY BINDING ARBITRATION RATHER THAN IN COURT, EXCEPT THAT YOU MAY BRING QUALIFYING CLAIMS IN SMALL CLAIMS COURT. YOU AND REVYR LABS WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY. YOU FURTHER AGREE THAT ANY ARBITRATION SHALL BE CONDUCTED IN YOUR INDIVIDUAL CAPACITY ONLY AND NOT AS A CLASS ACTION OR OTHER REPRESENTATIVE ACTION, AND YOU EXPRESSLY WAIVE YOUR RIGHT TO FILE A CLASS ACTION OR SEEK RELIEF ON A CLASS BASIS.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to legal@revyrlabs.com within 30 days of first accepting these Terms. Your opt-out notice must include your name, address, and a clear statement that you do not wish to resolve disputes through arbitration.

13. Governing Law and Dispute Resolution

These terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Travis County, Texas, or through binding arbitration as set forth in Section 12.

14. Force Majeure

Revyr Labs shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, war, strikes, or governmental restrictions.

15. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

16. Assignment

You may not assign or transfer these terms or your rights under them without Revyr Labs’ prior written consent. Revyr Labs may assign these terms without restriction.

17. Entire Agreement

These terms constitute the entire agreement between you and Revyr Labs regarding the Services and supersede all prior or contemporaneous communications, proposals, and representations.

18. Changes to Terms

We may update these terms as needed. Changes will be posted on our website with an updated effective date. Continued use constitutes acceptance of changes. Material changes will be notified via email to registered users.
